Conditions of Sale
The following conditions are both of sale (including any resale or subsequent assignment) and conditions of attendance at the event:
No refund or exchange on any ticket except as required by law and as otherwise specified by the seller. If a refund is made, King Valley Balloon Fiesta may, to the extent permitted by law, retain any fee it has charged.
The right is reserved to add, withdraw, reschedule or substitute artists and / or vary advertised programs, prices, venues, seating arrangements and audience capacity.
The right is reserved to charge a fee for the replacement of tickets.
It may be a condition of entry to individual events that the search of person and / or their possessions will be required at the time of the entry to the venue.
Entry may be refused if tickets are damaged or defaced in any way or are not purchased from King Valley Balloon Fiesta or other authorised points of sale.
Tickets may not, without the prior written consent of King Valley Balloon Fiesta and the seller, be resold or offered for resale at a premium (including via on-line auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission.
Scalping warning: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.
Refusal of Entry
For the comfort, safety and enjoyment of all patrons, the King Valley Balloon Fiesta and Wangaratta Turf Club has right to:
Refuse entry to any persons deemed to be intoxicated and / or disorderly;
Refuse entry to any unauthorised persons;
Refuse entry of items which have the potential to cause injury or public nuisance (ie. large flags/banners, musical instruments etc).
General Conditions
The King Valley Balloon Glow reserves the right to inspect/search bags brought into or out of the Wangaratta Turf Club.
Persons gaining unauthorised access to the Wangaratta Turf Club and/or the race track may be liable for prosecution.
Patrons who cause a disturbance or refuse to comply with requests made by representatives of the Wangaratta Turf Club or King Valley Balloon Fiesta staff will be evicted from the venue.
Alcoholic beverages cannot be taken into or out of the racecourse by patrons.
Smoking on the premises is only permitted in designated smoking areas and not within seating or enclosed areas.
Customers wishing to bring personal items into the Wangaratta Turf Club Racecourse do so at their own risk.
The Wangaratta Turf Club or King Valley Balloon Fiesta will not be held responsible for any damages to, loss or theft of a patron’s personal property.
Shade structures or large shade umbrellas cannot be brought into the King Valley Balloon Fiesta at the Wangaratta Turf Club Racecourse.
Unauthorised soliciting and customers surveying is not permitted.
Liquor Licensing
All patrons entering the course are advised that:
They are entering a licensed premises
Intoxicated persons will not be permitted to enter
Persons in possession of liquor will not be permitted to enter
Checking procedures will apply to prevent persons possessing liquor from entering
Intoxicated persons will be removed from the premises
It is an offence for minors to purchase and consume liquor
It is an offence to purchase liquor for (or supply liquor to) minors
Persons supplying liquor to minors will be reported to the Police and penalties apply under the Liquor Act 1982.
Responsible Service of Alcohol and Behaviour
In line with Responsible Service of Alcohol best practice, Wangaratta Turf Club and King Valley Balloon Glow reserves the right to refuse service to any person who is considered intoxicated. Staff are instructed that alcoholic beverages are not to be served to guests under the age of 18 years, or to guests in a state of intoxication. If a person is in breach of the liquor licensing laws they may be removed from the Racecourse.
Behaviour – Guests are required to have regard for the amenity of the facilities and their enjoyment by all guests. Any breach of acceptable behavioural standards will result in removal of guests from the marquee area.
Restricted/Prohibited Items
The following restricted/prohibited items are not permitted into the King Valley Balloon Glow venue at the Wangaratta Turf Club Racecourse:
Glass
Shade Umbrellas
Alcoholic beverages
Personal BBQ’s
Pets
Flares / Fireworks
Laser pointers
Knives or other dangerous weapons
Refund/Cancellation Policy (Packages & Admission)
If for any reason a booking is cancelled the following conditions will apply:
Within 5 days of the event—No refund applicable
COVID-19
Please do not attend the racecourse if you are unwell, or have COVID-19 symptoms.
You are entitled to a refund in the event that you cannot attend due to these circumstances.
Notice of Filming & Photography
Please be aware that official photographers are work during the King Valley Balloon Glow.
When you enter Wangaratta Turf Club, you enter an area where photography, audio, and video recording may occur.
By entering the event, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by King Valley Balloon Glow and its affiliates and representatives.
Images, photos and/or videos may be used to promote similar King Valley Balloon Glow events in the future.
By attending the event, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged.
COVID-19 CONDITION OF ENTRY
1. You acknowledge and accept that entry implies acceptance of the conditions of entry relating to COVID-19 which have been established for the health and safety of all attendees, staff and participants that will enter the Venue.
2. You acknowledge and agree that your entry will be subject to directions issued by Victoria’s Chief Health Officer pursuant to the Public Health and Wellbeing Act 2008 (Vic) and/or otherwise under relevant Victorian law, which you understand may be updated from time to time.
3. Failure to comply with these conditions will result in you being refused entry or evicted from the Wangaratta Turf Club.
4. If you are a person that will enter Designated Premium Ticket Area, you acknowledge and agree
a. you have evidence of being at Vaccinated; or
b. within 3 days in advance of entering the Venue, you provide to the Staff when requested both (i) a medical certificate from a registered medical practitioner certifying that because of a specified medical contraindication you cannot safely have a COVID-19 vaccine, and (ii) a certified COVID-19 test result confirming that you have tested negative to COVID-19 dated within 3 days in advance of entry to the Venue: or
c. or in accordance with the Victoria’s Chief Health Officer pursuant to the Public Health and Wellbeing Act and Covid19 regulations and health orders at the time of the event.
5. While the conditions of entry relating to COVID-19 are designed to reduce the risk of transmission of COVID-19, it is not possible to eliminate that risk entirely. You acknowledge that by entering the Venue you assume the risk of suffering an illness or fatality related to COVID-19.
Key Terms
COVID-19 vaccine means a vaccine to protect a person against COVID-19 that has been registered or provisionally registered by the Therapeutic Goods Administration
Evidence means:
(a) a form of government issued photo identification showing the person's name and place of residence; and
(b) a digital certificate or other evidence from the Australian Government that the person is Partially Vaccinated or Fully Vaccinated.
Fully Vaccinated means having received the prescribed number of doses of a COVID-19 vaccine as recommended by the Australian Technical Advisory Group on Immunisation (ATAGI) for full COVID-19 vaccination.
Partially Vaccinated means having received a dose of a COVID-19 vaccine that is less than the number of doses of a COVID-19 vaccine as recommended by the Australian Technical Advisory Group on Immunisation (ATAGI) for Full Vaccination.
